In divorce mediation, the spouses meet together with a neutral mediator, whose role is to facilitate discussion and provide broad-based, unbiased advice. Apart from the mediator, the meeting is strictly confidential, and is in that way similar to collaborative practice approaches to divorce. The mediator informs the couple about what the law might provide them, and pinpoints areas where an expert such as an accountant or mental health professional may need to be brought in for consultation.

Although neither spouse can have an attorney present in the meeting, it is often beneficial for each to have consulting counsel with whom they can meet before and after the meeting.
