At Chase, Berenstein and Murray, Counselors at Law, In Burlingame, California, we offer different processes to help clients resolve their family law matters, such as divorce, child custody and support, Mediation, Collaborative Practice and Litigation.  Depending upon your unique situation, one method may be better than another to bring about a resolution.

Collaborative Practice (Collaborative Law)

In Collaborative Practice, you and your spouse each hire an attorney trained in Collaborative Practice.  All commit to forgo going to court and litigating, and instead work together in a series of meetings to reach a satisfactory agreement which addresses the concerns of all members of the family.  This confidential process facilitates open communication, integrity and transparency amongst the participants.  You, not the court, decide the outcome of your case, as all the decisions are reached by agreement between you and your spouse.

Mediation  

In mediation, you and your spouse meet with the mediator, who is a neutral third party.  As a mediator, I assist you in identifying areas of agreement and issues that require resolution.  I then facilitate information gathering and discussion regarding the matters to be resolved.  I bring my experience to the process by making suggestions for your consideration.  You, not the court, decide the outcome of your case, as all the decisions are reached by agreement between you and your spouse.

Consulting Counsel in Mediation.

As consulting counsel in mediation cases, I serve as consultant for one of the parties.  I provide legal analysis and assist my client in considering options to achieve a settlement.   I review all agreements with my clients to ensure that they understand their rights and obligations under the written agreement. 

Litigation

In cases where the parties cannot reach a resolution by agreement, or where one party is unwilling to work with the other to move through the dissolution process, litigation offers methods of compelling a party’s participation, and a Judge to make decisions for the parties.  I continue to represent clients in litigation, and vigorously advocate for my clients interests. 

You must decide which method of dispute resolution, Collaborative Practice, mediation or litigation is most comfortable for you.
